Batbox Privacy Policy

Effective Date: January 1, 2026 

Protecting your private information is a priority to us. This Privacy Policy explains how we collect, use, share, and protect information when you interact with our venues, products, website, mobile applications, booking systems, and other services (collectively, the “Services”). Batbox Holdings, Inc., and its affiliates, subsidiaries, and parent companies may be referred to in this Privacy Policy, collectively, as “Batbox,” “we,” “us,” or “our.” By accessing or using any of our Services, you agree to this Privacy Policy where allowed by law.

As used herein, the term “personal information” means information that relates to an identified or an identifiable individual (e.g., your name, physical address, telephone number, email address, social security number); and the term “non-personal information” means any information other than personal information that Batbox may collect from you, including anonymized, aggregated or de-identified data.

  1. Information We Collect

We collect personal and non-personal information from and about you in a variety of ways, including:

  1. Information You Provide to Us
  • Name, email address, phone number, birthdate, zip code, and other personal identifiers.
  • Marketing preferences and opt-in status for email, SMS, or push communications.
  • Gameplay-related data including simulator usage, scores, preferences, and history.
  • Venue-related data including event booking details and food & beverage purchase history.
  • Swing video recordings submitted or captured during simulator use (non-biometric).
  • User-generated content such as feedback, surveys, and reviews.
  1. Information We Collect Automatically
  • IP address, device ID, browser type, operating system, referral URLs, and location (general).
  • Session activity, page views, bounce rates, and time on platform.
  • Cookies, pixels, and tracking technologies (see our [Cookie Policy]).

We may use anonymized IP-based location data solely to enhance user experience (e.g., preselecting country code). We do not collect or store precise geolocation information.

  1. Visual and Behavioral Analytics
  • Video footage captured in venues for gameplay highlight reels and AI training (aggregated only).
  • Non-identifying data used for analyzing player enjoyment, session performance, or venue experience.
  • Display of recorded highlights or swing videos on in-venue TV screens with prior user consent.

We do not collect or store credit card data directly. All transactions are processed securely through third-party providers like Stripe and GoTab.

Sensitive Personal Information

Unless we request it, we ask that you not send us, and you not disclose, any sensitive personal information (e.g., information related to race or ethnic origin, political opinions, religion or other beliefs, health, genetic, or biometric data, criminal background or union affiliation) on or through the Services or otherwise to us.

  1. How We Use Your Information

We use the personal information we collect for the following purposes:

  • To operate and improve our website, apps, booking systems, and simulator experiences.
  • To personalize your interaction with Batbox (e.g. remembering preferences, game history).
  • To enable account creation, simulator login, and venue check-in.
  • To manage and support event bookings, partner lead generation, and customer service.
  • To send relevant communications such as promotions, product updates, or venue alerts.
  • To collect feedback, conduct surveys, and improve our features and offerings.
  • To support internal analytics, such as gameplay patterns or F&B trends.
  • To share session highlights and gameplay content (with user consent).
  • To train AI models using aggregate gameplay footage for improving system performance.
  • To comply with legal obligations, enforce policies, protect against fraud, or when we believe that such use is necessary or advisable (including, without limitation and by way of example only, to investigate, prevent or take legal action against someone who may be causing injury to, interfering with, or threatening our rights, obligations or properties or those of a user of our Services or to further our legitimate business interests)..

We do not limit the ways in which we may use non-personal information, including aggregated and/or de-identified data. 

  1. Data Sharing and Third Parties

We do not sell or rent your personal information. We may share it only with:

  • Service providers that assist with bookings, customer support, analytics, marketing, or CRM (e.g. GoTab, Seven Rooms, Klaviyo, HubSpot, Google Analytics, Meta).
  • Payment processors (Stripe, 7ROOMS) to facilitate secure transactions.
  • Business partners or licensees, only as required to deliver services you’ve requested.
  • Law enforcement or regulatory bodies when legally required.

All third parties are contractually required to handle your data securely and may not use it for their own marketing or resale.

  1. Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies to collect behavioral data, measure campaign performance, and personalize your experience. See our Cookie Policy for full details and how to manage preferences.

If you do not want to receive cookies, you can also change your browser settings on your computer or other device you are using to Access the Services. Most browsers also provide functionality that lets you review and delete cookies. 

  1. Children’s Privacy

We do not knowingly collect personal data from children under the age of 13 without parental or guardian consent, in accordance with the Children’s Online Privacy Protection Act (COPPA).

  • Only adults (18+) may make purchases or bookings.
  • All minors (under 18) must have a parent or legal guardian sign a waiver to participate in any Batbox activities.

If we discover we’ve collected information from a child without proper consent, we will delete it promptly.

  1. Your Privacy Rights

Depending on your location, you may have the following rights:

  • Confirm: You may confirm whether we process your personal information.
    • Access: You can request a copy of the personal information we hold about you. You can request a copy of information about you in machine readable form if you reside in a jurisdiction where that right is provided by law.
    • Correction: You may request corrections to your personal information.
    • Deletion: You may request that we delete your information, subject to legal exceptions.
  • Object to, limit or restrict use of personal information. You can ask us to stop using all or some of the information about you or to limit our use of it. 
  • Opt-Out: You can opt out of marketing emails, texts, or push notifications at any time as well as sharing of sensitive personal information. You may also withdraw permission for us to process personal information about you for certain purposes, including targeted ads and email marketing by us.

Notwithstanding the above, please note that we may still need to retain personal information necessary to provide you with products or services that you have purchased. 

To exercise any of these rights, please contact us at privacy@batbox.io. We may verify your identity before fulfilling your request.

If we decline to act on your request to exercise your privacy rights, you may appeal that decision by sending an email explaining the basis for your disagreement with that decision to privacy@batbox.io.

  1. Data Retention and Security

We retain your data for as long as necessary to fulfill the purposes outlined in this Policy, or for up to 24 months following your last interaction with us, unless a longer period is required by law.

  • All data is stored on encrypted AWS servers located in the United States.
  • Data is encrypted both at rest and in transit.
  • Access to data is restricted and monitored to protect against unauthorized use.
  1. Your California Privacy Rights

Customers who are California residents may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share our customer’s personal information with unaffiliated third parties for their own direct marketing purposes, without their approval.

If at any time you wish to opt out of having your personal information shared with third parties and/or receiving information from Batbox about new products, services, or promotions, please contact Batbox to notify them of this via the Contacting Us section below. We will be happy to honor your request.

California Consumer Privacy Act (“CCPA”)

If you are a California resident, you have the following specific privacy rights:

  • The right to request a report showing the Personal Information collected, shared, and sold about you in the past twelve (12) months;
  • The right to request that we delete any of your Personal Information we have collected from you (subject to certain limitations set forth in the CCPA); and
  • The right to opt-out of the sale of your Personal Information.

We shall not discriminate against you based upon the exercise of any of the above rights. You or your authorized agent may submit a request to exercise any of the above enumerated right by contacting us in accordance with the Contact Us section of this Privacy Policy.

California Privacy Rights for Minor Users

If you are a California resident and under the age of eighteen (18), you have the right to view, correct or delete any Personal Information provided by you or publicly posted by you. You may do so by contacting us in accordance with the Contacting Us section of this Privacy Policy.

We will be happy to review, update or remove Information and/or content as appropriate. Residual copies of Information and/or content that have been deleted may remain in our backup systems. We may still retain your Information to resolve disputes, enforce our user agreement, or comply with legal requirements; in this case, your personal information will be blocked from use for any other purpose.

  1. Users outside the United States.

We are headquartered in the United States of America. Personal information may thus be accessed by us or transferred to us in the United States. By providing us with personal information, you consent to the storage or processing of your personal information in the United States and acknowledge that the personal information will be subject to the laws of the United States, including the ability of governments, courts or law enforcement or regulatory agencies of the United States to obtain disclosure of your personal information.

We will protect the privacy and security of personal information according to this Privacy Policy, regardless of where it is processed or stored.

  1. Changes to This Policy

We may update this Privacy Policy periodically. Continued use of our Services indicates acceptance of the updated privacy policy where allowed by law.
